Welcome to our mobile application and / or our website. This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.hiredriverz.in website and (name of App) Application for mobile and handheld devices.

1) These terms and conditions are applicable to all our offers given via Call / Mobile App/ Website. If you (the viewer) do not agree with the terms of use, please do not access and use this Website / Application/ Call / Mobile App.

2) By registering as a customer of HireDriverz Ltd., you (hereinafter alternatively referred to as “Client”, “Customer”, “you” or “your” as the context requires) are agreeing to the following Terms and Conditions.

3) Your registration with (name of App) means you would be sharing your personal information such as Name, Email ID, Mobile No, Address, Car / Vehicle Details with us, and we would be using this information to provide you our access & services.

4) The Terms and Conditions constitute a binding contract between you and HireDriverz Ltd. (alternately referred to herein as this “Contract”, “Terms and Conditions” or “Agreement” as the context requires).

5) Definitions –

• “Application” shall mean the application supplied by HireDriverz and downloaded and installed by you on your single mobile device (smart phone) / Hand Held Device / Tablet/ Pad;
• “Driver” or ‘’Drivers’’ shall mean the driver engaged by you by using our Website/Application;
• “Service” or “Services” shall mean the service of providing short-term private driver solutions via the Application/Website as defined;
• “User’’ or “Users’’ means any person who is accepting our services; and
• “Website’’ shall mean the website www.hiredriverz.in.
• “Customer” is a person or entity that utilizes HireDriverz app platform to avail his/her/their designated driving services.

6) General Terms of Service –

• HireDriverz app is just a aggregating platform, customer request for services are floated to nearest driver, their availability and functioning is not governed by HireDriverz.
• We ensure that all our drivers reach you on time, but there are various factors that may affect the quality of service. We don’t accept any delay related matters unless the same is purposeful proved.
• Delay in reaching you towards the fulfilment of service would not be compensated with any amount or settlement. We shall try and ensure action against the concerned driver, after our team investigates the reason and discussion with you.
• Our drivers will wait maximum 15 mins, at the location and destination mentioned by you, after which the driver would start the trip and your duty calculation would start.
• You may cancel the booking within 45 minutes or the driver taps on the way on your screen/ mobile prior to the time of journey, without any cancellation charges for all Services. The customer is liable for Rs 250/- charge if the trip is cancelled thereafter.
• When a trip ends, driver will end up the trip on HireDriverz app on his mobile device. The total fare amount will be calculated and the same would also appear on your mobile device. You may pay the amount via cash or a variety of online payment options available on the app including payment via HireDriverz Wallet, where you may have already pre-loaded funds.
• The User shall pay parking charges, additional night surcharge (where applicable), one-way trips, toll charges and any fee or levy presently payable or hereinafter imposed by the law or required to be paid for availing of the Services.
• Any payment related issue, except when such issue is due to an error or fault in the Site or Application, shall be resolved between you and the payment processor. HireDriverz shall not be responsible for any false claims.
• We may offer schemes and promo from time to time, which may be discontinued as per the management wish without any prior intimation to you. You agree that any codes given would have an expiry date or limit to use.
• HireDriverz shall further not be liable for damages resulting from the use of, or the inability to use, electronic means of communication with the Website/Application, including — but not limited to — damages resulting from failure or delay in delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and transmission of viruses.
• HireDriverz under no circumstance accepts liability in connection with and/or arising from the services provided by the driver or any acts, actions, behaviour, conduct, and/or negligence on the part of the driver.
• We shall not be held liable for any failure or delay in performing Services where such failure arises as a result of any act or omission, which is outside our reasonable control such as unprecedented circumstances, overwhelming and unpreventable events caused directly and exclusively by forces of nature that can be neither anticipated, nor controlled, nor prevented by the exercise of prudence, diligence, and care, including but not limited to: war, riot, civil commotion; compliance with any law or governmental order, rule, regulation or direction and acts of third parties (“Force Majeure” ).
• We have taken all reasonable steps to prevent internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we shall not be held liable in the unlikely event of a breach in our secure computer servers or those of third parties other than as required under applicable law.
• HireDriverz does not represent or endorse the accuracy or reliability of any information, or advertisements (collectively, the “Content”) contained on, distributed through, or linked, downloaded or accessed from or contained on the Website/Application, or the quality of any products, information or other materials displayed, or obtained by you as a result of an advertisement or any other information or offer in or in connection with the service.
• We use third party services and tracking tools, we also use third party to deliver us services and we have signed agreement with all our trusted partners.
• Links to third party sites are provided by the Application / Website as a convenience to users and HireDriverz does not have any control over such sites i.e. content and resources provided by those sites.
• We may allow you/users to access third party website / apps/ offers etc. You are requested to read their terms & condition and also their privacy policy, before using any such site / apps services. The user understands and acknowledges that HireDriverz is not in control of any third party misleads or issues.
• You hereby confirm, represent and warrant that the vehicle is in good operating condition and meets the industry safety standards and all applicable statutory requirements for a motor vehicle of its kind.
• You will be solely responsible for any and all liability which results from or is alleged as a result of the condition of your vehicle, legal compliance etc. including but not limited to personal injuries, death and property damages.
• You are named or scheduled on the insurance policy covering the vehicle you use when engaging our services. You have a valid policy of liability insurance (in coverage amounts consistent with all applicable legal requirements) for the operation of your vehicle to cover any anticipated losses related to your participation in the services or the operation of your vehicle by the driver. In the event of a motor vehicle accident, you will be solely responsible for compliance with any applicable statutory or department of motor vehicles requirements and for all necessary contacts with your insurance provider. Other than any personal criminal liability attaching to the Driver you will be solely responsible for all consequences arising out of the use of the Service or the Driver. In any event HireDriverz shall have no responsibility or liability on this account whatsoever.
• You will be solely responsible for the full functionality of your vehicle. If your vehicle fails to function (electrical, mechanical or other) in any way during the course of service, you will be solely responsible for all storage fees, roadside assistance, alternate transportation and repair of any kind and neither HireDriverz nor the concerned driver shall be responsible in any manner whatsoever.
• The customer must ensure that the vehicle being used for the service possesses valid documents, including the RC book, insurance copy, and Pollution Under Control (PUC) certificate. These documents are mandatory & vital for a smooth service experience.
• The customer agrees not to cause any distractions or disturbances during the service, ensuring both their safety and the driver's safety on the road. Distractions, whether verbal or otherwise, can compromise the safety of everyone involved.
• The driver or the company cannot be held responsible if the customer's vehicle has tinted glasses or dark films, especially if this leads to police intervention or penalties.
• HireDriverz reserves its right to deny access to particular user to any/all of its services without any prior notice/explanation in order to protect the interests of HireDriverz and/or other users to the Website/Application.
• We reserve the right to terminate your account or your access to the Website/Application immediately, with or without notice to you, and without liability: a) if you have violated any of the terms of use; b) if you have furnished us with false or misleading information; c) Pursuant to requests by law enforcement or other government agencies; d) in case of unexpected technical or security issues or problems; e) in case of discontinuance or material modification to the Services (or any part thereof); and / or f) in case of interference with use of our Website/Application by others.
• These terms of use shall remain in full force and effect while you have an account with us and even after termination of your account with us, certain provisions of this terms of use will remain in effect, including but not limited to, Intellectual Property Rights, Prohibited Uses and Indemnification. You agree that we will not be liable to you or any third party for taking any of these actions.
• HireDriverz is the sole owner or lawful licensee of all the rights to the Website/Application and its content. Website/Application content means its design, layout, text, images, graphics, sound, video etc. The Website/Application content embodies trade secrets and intellectual property rights protected under worldwide copyright and other laws. All title, ownership and intellectual property rights in the Website/Application and its content shall remain with HireDriverz.
• All content on this Website/Application is the copyright of HireDriverz except the third-party content and link to third party website on our Website/Application, if any.
• Systematic retrieval of HireDriverz content to create or compile, directly or indirectly, a collection, compilation, database or directory (whether through robots, spiders, automatic devices or manual processes) without written permission from HireDriverz is prohibited.
• In addition, use of the content for any purpose not expressly permitted in this Terms of Use is prohibited and may invite legal action. As a condition of your access to and use of Services, you agree that you will not use the Website/Application to infringe the intellectual property rights of others in any way. HireDriverz reserves the right to terminate the account of a user upon any infringement of the rights of others in conjunction with use of the Service, or if HireDriverz believes that User’s conduct is harmful to the interests of HireDriverz, its affiliates, or other Users, or for any other reason in ______________ sole discretion, with or without cause.
• HireDriverz or the driver has the right to refuse the service in the following circumstances: a) if the User is found to be in an intoxicated state or is found misbehaving with other passengers or the Driver, or is causing a nuisance; b) if the User is misusing, soiling or damaging any of the devices (technical/non-technical) of the Driver; and if the User asks the Driver to break any traffic/RTO/city police and/or government rules for any purpose the Driver has the right to refuse such a request by the User.

7) Cancellation & Refund Policy –

• HireDriverz drivers will wait for not more than 15 minutes from the requested trip start time, before they start the trip timer.
• In case if you wish to cancel the booking the same can be done 45 minutes prior to the trip start time; in case if the driver has already ticked / updated “On the Way” denotation, your cancellation would be possible subject to charge of Rs. 250/-.]
• The user agrees to pay the aforesaid Rs. 250/- by cash to the driver directly.
• HireDriverz would not be responsible for any reverse of payment/ or refund or any other such payment.
• The User can notify HireDriverz within 24 hours if there is any adjustment/wrong calculation of trip value. HireDriverz will provide the credit/will make necessary adjustments in the wallet for such cases after proper evaluation. All invoices/credit notes are downloadable from the Dashboard.

8) Terms and conditions for hiring Permanent Driver –

• Joining of duty will be confirmed only after acceptance of terms of service and terms of employment by duly signing.
• We charge Membership Fee Rs. ______/- for the selected driver with unlimited replacement guarantee. The Membership fee is towards providing driver and does not include any kind of loss, damage & theft cover.
• The contract will be valid for ___ months.
• In case if the driver wants to leave the job, he will give you 15 days’ notice period
• The agency will not be responsible if the employer gives advance, mobile, uniform etc. to the employed driver and any loss to the said things at the hands of drivers.
• In case the driver goes on leave for 1 or more days, we will arrange a temporary driver with applicable charges and same can be deducted from your permanent driver’s salary.
• In case of any offence committed by the driver on duty the agency will help the client with local police station.
• Drivers’ documents shall be provided by the agency at the time of signing the membership.
• Any dispute to the jurisdiction of Mumbai court only.
• In case you want to discontinue the driver from job you need to give him 1 week notice & during this notice period you can avail replacement from the agency at no extra cost.
• The payment of Membership Fee has to be released within 2 days after the driver has joined the duty, failing which the service might be terminated.

9) Indemnity –

• The User shall defend, indemnify and hold, HireDriverz, its affiliates, its licensors and each of their officers, directors, other users, employees, attorneys and agents, harmless, from and against any and all claims, costs, damages, losses, liabilities and expenses arising out of or in connection with – (a) violation or breach of the terms of use or any applicable law; (b) Regulation, whether or not referenced herein; violation of any rights of any third party, including the driver via Application/Website; and use or misuse of the Application/Website or Service.

10) Miscellaneous –

These Terms of Use may be modified from time to time in our sole discretion. It is your responsibility to review these Terms and Conditions from time to time. If you continue to use the Service after notice of change has been intimated or published on our Website/Application, you thereby provide your consent to the changed practices on the same terms hereof. For this reason, we encourage you to review these Terms of Use each time you access and use the Website/Application. Most content and some of the features on the Website/Application are made available to Users free of charge. However, HireDriverz reserves the right to terminate access to certain areas or features of the Website/Application at any time for any reason, with or without notice. The above-mentioned Terms & Conditions and our Privacy Policy constitute the complete agreement of service between the Driver, Company and User in respect to the use of Website / Call Centre / Mobile app.

11) JURISDICTION –

The courts of __________, India shall have the sole and exclusive jurisdiction in respect of any matters arising from the use of the services offered by HireDriverz to its user/s. We request you to check our Rate Chart for updated rates and charges applicable in your area/ city/ state.
